Access issues typcially require the joint effort of various expertise. Each case is unique and the needs may vary. Dabbagh & Associates provides expert support in areas such as translation, reunification, legal expertise, and domestic violence. Working as a "team" the combined expertise is focus on one thing...supporting the efforts of parties in dispute to reach agreements.

We work in coopertaion and coordination with those agencies that hold a stake in the case. These are called "stakeholders". This prevents confusion as well as provides for the greatest degree of coopertaion and assistance to those that hold an interest in supporting the resolution of a case.

Alternative Dispute Resolution (ADR) encompasses a variety of methodologies that allow disputants to work out a solution that both benefit from. The mediator, or negotiator is trained, skilled, and experienced specially in cross border conflicts, and works to facilitate communications between the parties. Mediators and negotiators are always neutral parties and do not take sides. Clients can be assured of complete confidentiality Even the mediator or negotiator's notes being protected against any attempt by a court to gain access to them. Cross Border ADR methodologies are designed to meet the needs of specific case types whether it is a pre-abduction mediation (Hague or Non-Hague) or post abduction, non-Hague (or Hague) case. Mediation is cheaper than litigation and the parties have the opportunity to suggest solutions that are right for them. Parties meeting to discuss possible resolution are not bound to come to an agreement, but rather have a choice on whether they are satisfied with the final proposals as to whether is is acceptable to them. Even in cases that have languished for years, ADR has proven successful with disputants coming to agreements that allow both to benefit from win-win solutions.

Negotiation

Negotiation, another form of alternative Dispute Resolution, is often utilized when the conflict is considered intractable and/or is plagued with vexatious litigation.  Ms. Dabbagh's training includes certifications from a vast variety of ADR methodologies, including Peace Keeping, Crisis Negotiations, and Crisis Analysis.  While intractable disputes are those in which the conflict seemingly cannot be resolved, negotiation methodologies has resulted in successful resolution. Like Mediation, the negotiator remains neutral, and facilitates communication between the parties. Typcially, negotiation begins by Dabbagh and Associates bringing a non-responsive party to the table, unlike mediation where both parties are agreeable to meet.

Arbitration

Dabbagh and Associates has provided expert witness assistance in cases where the parties litigate in a court of law. Whether it is criminal court or civil court, Dabbagh and Associates has provided expert wtiness testimony for more than a decade across the USA and in Europe. In this capacity, we are able to educate the court on complex issues ranging from Shariah law, to issues revolving around dual nationality, international treaty, FGM, and much more.
