Parental Kidnapping

Dabbagh & Associates works within the "best practices" of the Hague and Malta Conference initiatives in Cross Border Family Mediation

Whether a child has been moved to another state or to another country, access and visitation can become problematic. Going to court to resolve such matters can be extremely costly, and time consuming. Mediation offers a way for families to craft their own custody and visitation agreement with the assistance of a Supreme Court certified Mediator. Their agreement is then presented to the court to be signed into order.

Whether families wish to prevent confusion when a move is expected, or if a child has already been moved and new custody or visitation arrangements are desired, mediation provides a private, legal process for families to do this, even if the child is moved to another country.

Hague Mediation

Parents may request that their Hague case be mediated. Save tens of thousands of dollars in legal fees and possibly years of litigation by mediating. Our trained cross border mediators are trained and experienced in Hague Abduction issues and can assist your family in crafting agreements that reflect your desires regarding custody and visitation wishes. The Hague Perment Bureau on Private Family Law and the U.S. Department of State/OCI endorse the use of mediation in abduction cases. Mediation of these issues will allow your family to settle these issues in a manner that is cost and time saving. As more and more Hague signatory countries develope cross border mediation programs, we are able to work with mediators from those countries in the capacity of co-mediation to provide parties representing different nationalities with mediators from those regions.

Our mediators are trained in various styles of mediations and speak a variety of languages, recognizing and respecting the cultural diversity of the families we serve.
As well, our mediators travel internationally to assist families caught in crisis. Our mediators go through 100 hours of intense abduction training (cross Border) beyond family mediation. Cross Border training is accredited through the Virginia Supreme Court and is the only program in the United States that honors diversity by utilizing alternative dispute Resolution Approaches from a variety of cultures as the mediators facilitates dialogue between parties.

Enforcement

Dabbagh ad Associates works with lawyer to review agreements for language and enforcement issues. Parties are invited to bring their lawyers to mediation as well as other advisors. Once an agreement is reached, it is submitted to the court of jurisdiction to be signed off on by the judge. Mirror orders can be sent to other countries, letting them know the parties have reached an agreement that is recognized by the courts.
