How We Do What We Do
There are many mediation approaches and methodologies. They include facilitative, evaluative, transformative, and experimental. However, there are other methods that have evolved from specific cultures. It is a 'myth" that one must construct a mediation methodology when working within cultural context.
All societies and cultures have developed ways to resolve conflicts. These vary greatly. A mediator can not possibly know the intimate cultural practices of all cultures, nor how they resolve conflicts. A family mediator from Virginia may be hard pressed to mediate in West Africa, incorporating "joking Kinship", but a cross cultural mediator familuar with this dynamic can mediate within the parties cultural context.
Dabbagh & Associates identifies, appreciates, and respects the cultural context of parties in disagreement. We do not impose established mediation approaches on parties that serve to deny them a process which recognizes their culure. As well, we recognize enforcement issues.
International disputes, or disputes that involved parties representing two or more jurisdictions may present enforcement issues. If the parties desire that their written agreement will be recognized within the legal framework of various jurisdictions the cross border mediator must experienced of those legal frameworks. At Dabbagh and Associates, our legal associates assist in providing language that identifies and utilizes federal and international law. Mirror orders alone, may not be enough to strengthen agreements.
